My ex-husbands federal and state refunds were withheld due to back child support…where does the money go?

My ex-husband hasn’t worked or paid child support in over 7 years. He finally got a job and his refunds were taken from him due to back child support. My children are on medi-caid, but no other assistance. Shouldn’t I be entitled to that money? Where does it go, and how do I try to get it?

Normally the state only takes your child support if you are on foodstamps or TANF, not medicaid. So yes, you would get sent that money, unless he owes the IRS or state for previous years, they get their money first. But it takes a while. The IRS holds onto any tax offsets for at least 3 months before releasing them to the child support agency, just in case an injured spouse form is filed, or there is another problem. Then the child support agency gets them, applies them to his account, and sends it off to you. That can take another month in some states. So it all depends on when he filed his taxes.

I have gotten my exes tax returns the past 2 years. The child support office receives this money and then should send it to you. Unless he is in the system for nonpayment for other kids. If he has other children before yours, they would get the majority of it I think. You need to contact your local child support office. If you aren’t involved with them already, google your child support in your city and that should help.
